This site is operated as a french Individual Enterprise, similar to a Sole proprietorship structure, by the owner as "Laurent DUBOSQ", also operating as data controller and publication director, having its main registered office at 49, RUE NATIONALE, 78520 LIMAY, FRANCE, e-mail: laurent.dubosq.business@gmail.com.

Our activity has been registered with the register of commerce and companies of VERSAILLES (FRANCE) under number 831 467 956. As the enterprise using the "Micro" declaration scheme orders are exempt from VAT.

PREAMBLE

The present general conditions of sale apply to all the orders placed with the Awakning Jewelry enterprise for the whole of the articles proposed by the www.awakningjewelry.com website by natural persons, not business persons. Consequently, the fact for any person ordering a product offered on sale on the Internet site of Awakning Jewelry implies full and complete acceptance of these Terms and Conditions of Sale that the Customer recognizes having been aware of before his order.

Awakning Jewelry reserves the right to modify at any moment the present document. Nevertheless, the Terms and Conditions of Sale applicable to the order placed by a Customer on the Site of Awakning Jewelry are those accepted by the Customer at the time of placing the order.

According to the current French legislation, our Terms and Conditions of Sale are the sole basis for commercial negotiation with our customers. If there is no written agreement, any order received implies the unconditional acceptance of our general conditions of sale, despite any stipulations to the contrary that may appear with the customer's order.
The fact that Awakning Jewelry does not refer at any given time to one or several provisions of the general conditions of sale cannot be construed as a renunciation and Awakning remains at all times free to demand their strict application.

ARTICLE 1 : INTEGRALITY & OBJECT

The purpose of these Terms and Conditions is to define the rights and obligations of the various parties in the context of the online sale of goods offered by the company Awakning Jewelry to its customers, from ordering to delivery, through payment and compliance with the guarantees. The company Awakning Jewelry is careful to be in accordance with French laws, European laws, the recommendations of the International Chamber of Commerce (ICC) including their International Trade Conditions (Incoterms) in their last version, the GDPR & CCPA.

The Customer is considered to accept without reserve the entirety of the provisions envisaged under these Terms and Conditions.

ARTICLE 2 : FIELD OF APPLICATION

The present Terms and Conditions of Sale govern the sale of products on the day the order is placed by the customer via the Awakning's Website ("https://www.awakningjewelry.com").

ARTICLE 3 : OUR ACTIVITY

Our activity is the selling of jewelry under our brand "Awakning".

Our mission is to enable people living in our modern western societies to draw the energy from the spiritual values they share with the Eastern philosophies to assert themselves and find well-being and harmony.

The values we associate with our brand and our ability to express the values and teachings of East Asian philosophies through our selection of jewelry represent our added value, justify the price, allow us to maintain our activity, to propose new products and introduce our brand to new people.

ARTICLE 4 : INFORMATION ON THE PRODUCTS

4.1 AVAILABILITY OF THE PRODUCTS

Awakning Jewelry is committed to deliver the orders received only within the limit of the stocks of the product available in the warehouse or within the limit of the stocks available from its suppliers. In the absence of availability of a product, Awakning Jewelry reserves a delay of 48 additional hours (2 working days) to operate the order with suppliers. This delay may affect the estimated delivery date and may extend it by one or two days.

If Awakning Jewelry cannot obtain an ordered product from its suppliers, the enterprise will notify the customer by email for the cancellation of the order and proceed to the total refund of payment as soon as possible, within 14 days.

4.2 DISPLAY OF UNAVAILABILITY

The unavailability of a product is mentioned on the product page with the "sold out" mention.

4.3 AGE REQUIRED FOR THE USE OF THE PRODUCTS

Our products are intended to be worn by people who are old enough to have an appetite for personal development and well-being as expressed by Eastern philosophies. This age cannot be defined in a fixed way, it depends on the maturity of each individual and their needs. Nevertheless, for safety reasons, we strongly advise against our products being entrusted to or worn by children or babies. Awakning Jewelry will not be held responsible for any accident related to the use of our products by them.

ARTICLE 5 : PRODUCT PRICE & TOTAL ORDER AMOUNT

5.1 PRODUCT PRICE

Each price binded to a product is shown as a price per unit.

5.2 CURRENCY

Prices are indicated in U.S. Dollar.

5.3 PROMOTIONS

We offer private promotions on our products accessible by email to our newsletter subscribers and from our website in a private area to people having created an Awakning account and connecting at https://www.awakningjewelry.com/collections/private-promotions.

We offer promotions every two weeks with a validity period of 14 days. We can sometimes organize periodic events such as promotions adapted to calendar events (Mother's Day, Christmas, etc.) or organize unexpected operations like private sales. The duration of our promotions can vary from 2 weeks to 2 months depending on the event.

Any of our promotions receive a visible marketing offer(s) with their periods of validity. The discounts are variable depending on the product and the event but have as limits the ceiling fixed by the French law prohibiting us to sell at a loss - Article L.442-5 French Commercial Code.

Some promotions may be reserved and shared to specific Customers, based on the interest they may have regarding Awakning Jewelry.

Please note that we only accept one promotional code per order. Our codes are subject to change and are not provided upon request. Each of our codes has an expiration date communicated to customers, and we cannot honor it if the promotional codes have expired. We are not currently affiliated with any third-party coupon sites, so if our customers can find codes there, they will be illegal and will not work.

5.4 VAT

As the enterprise is an French individual enterprise using the "micro" declaration scheme, orders are exempt from VAT, even for international orders.

5.5 DELIVERY COST

Each order is automatically charged by a basic delivery amount. More information about delivery fees in the article "8.3 Delivery Cost".

5.6 OPTIONAL FEE

Any ordering options, such as a faster delivery method for example, will be at the expense of the customer.

5.7 TOTAL AMOUNT

After the customer has clicked on the "CHECK OUT" button in the Cart, the total amount will be shown at each step of the "Check Out" sales tunnel. The payment requested from the customer corresponds to the total amount of the purchase, once the points mentioned above have been processed.

5.8 PRICES, TAXES & CONTRIBUTIONS EVOLUTION

Since the prices charged by Awakning Jewelry's suppliers are in constant evolution, the prices posted on the site are also likely to be modified constantly. However, the prices cannot be modified once the Customer has placed his order.

In the same way, if one or more taxes or contributions is suddenly created or modified, whether it rises or falls, such a change could be reflected for future orders by a modification of selling prices of the products and could be displayed in the "Check Out" sales tunnel.

ARTICLE 6 : ORDER

6.1 CAPACITY TO ENTER INTO CONTRACT

The customer interested in an article visible on the website www.awakningjewelry.com may order directly via this same website.

The Customer can place his order there 24 hours a day, 7 days a week.

Every Customer of the Awakning Jewelry enterprise declares that he/she has the capacity to enter into a contract on the conditions described hereafter, i.e. to be an emancipated minor or have reached legal majority and not to be protected within the meaning of article 488 of the French civil code.

6.2 ACCEPTANCE OF THE CONDITIONS & COMMITMENT

Every order implies acceptance of the prices and description of the products available for sale.

During the buying process, the customer has to ensure that he/she has read, understood and consent to our Terms and Conditions of Sale and our Privacy Policy by ticking the box "I agree with the terms and conditions of sale and the privacy policy" in the cart. This mention is provided with the necessary links required to access the mentioned policies in force.

In every case, the supply online of the bankcard number and the final validation of the order by the Customer will constitute proof of the order and current liability for the sums for the products selected in the order. This validation constitutes an irrevocable acceptance of all the operations carried out on the www.awakningjewelry.com website.

6.3 RIGHT TO MAKE A MISTAKE

Each customer has a period of 30 minutes after placing his order to request a change by contacting expressly Awakning Jewelry from the contact page or directly by email to contact@awakningjewelry.com. Beyond this period, Awakning Jewelry may attempt to have the erroneous information corrected but without any guarantee that it can be taken into account in time by its supplier.

6.4 LANGUAGES FOR SUBMISSION

The submission of orders to Awakning Jewelry is carried out in English. French can also be used by customers when they contact us, if they wish.

6.5 RIGHT OF REFUSAL

Awakning Jewelry enterprise reserves the right to suspend the processing and delivery in the case of a payment authorization by bank card being refused by officially accredited organizations or in the case of non-payment according to article 121-11 of the french consumer code. Awakning Jewelry enterprise notably reserves the right to refuse to process and deliver an order placed by a client with whom a dispute over payment has still not been settled or get acquainted with all excessive inconveniences relating to delivery or legislation in force in the country concerned.

6.6 IDENTITY CHECKING PROCEDURE

Within the framework of a procedure for checking orders intended to make sure that no one uses the banking coordinates of another person without his knowledge, the Customer may be requested to send proof of identity and/or proof of residence by email to Awakning Jewelry enterprise. The order will be confirmed only after reception and checking by our services of the details sent. In the absence of reception of these elements or if there is any doubt about their authenticity at the end of the 14 days following the placing of the order, the order will be cancelled and the amount paid will be refunded within 14 days.

6.7 CONFIRMATION OF ORDER

An email is automatically sent to the customer in order to confirm the order, provided that the email address indicated in the inscription form does not contain an error. The Customer must check the completeness and conformity of the information which he provides and the content of the order. Awakning Jewelry cannot be held responsible for possible errors of data-entry and the consequences in terms of delay or delivery error. In this context, all the expenses engaged for resending will be the responsibility of the Customer.

6.8 ORDER & TRANSFER OF PROPERTY

Once the order is confirmed, Awakning Jewelry becomes responsible for the performance of the contract. The enterprise stays the owner of the entire product(s) sent for the order, until the delivery has been made to the address specified by the customer and that all goods have been paid for.

6.9 STATUS OF THE ORDER

The Customer can at any moment check the status of its order since his account interface by clicking here, or at the address "https://www.awakningjewelry.com/account", or by clicking on the human icon on the top right of the screen for a desktop display, or on the menu icon then "Log in" for a smartphone/tablet display. This following of the order makes it possible for the Customer to know the stage of processing of his order, but also the stage of sending or delivery of his parcels.

6.10 PROOF OF THE ORDER & RECEIPT

The computerized registrations, preserved in the information processing systems of Awakning Jewelry enterprise under reasonable conditions of security, will be regarded as the evidence of the communications, the orders and the payments that have taken place between the parties.

The filing of the purchase orders and the receipts are carried out on a reliable and durable support which can be produced as proof.

The Customer has, both in the Order and Shipping Confirmation emails, the link to download in PDF format, the original receipt of its order. Note that the receipt does not come with the parcel. The purchase order which the Customer creates online or the confirmation of the order sent by email to the Customer by Awakning Jewelry does not act as a receipt. Only the receipt is authentic.

Awakning Jewelry preserves an electronic example of each receipt. Also, it is possible for customers to contact the customer service to obtain any of their receipts.

6.11 PROCEDURE TO PLACE AN ORDER (Help to customers)

To help the customer to place an order, we have written a simple procedure to follow using a credit card:
  1. Choose in the product pages the different items you are interested in and click successively on the "Add to cart" button if you intend to buy it.
  2. Once you have made your selection, go to the shopping cart by clicking on the cart at the top right of the screen. In this shopping cart page, you have the possibility to view, modify, cancel or validate your cart. Once you agree with your shopping cart, you will need to check the box in front of "I accept the terms of sale and privacy policy" if you agree with and click on the "Check Out" button to enter in the Check Out sales funnel.
  3. Once in the funnel, at the information step, simply enter the data required for an order, i.e. your e-mail address and your delivery address. Then, validate this step by clicking on the "Continue to shipping" button.
  4. Once in the Shipping step, you will have to choose your shipping method, by default "Standard + Tracking", then click on the "Continue to payment".
  5. Once in the Payment step, select "credit card" and fill in your credit card information, then click on the "Review Order" button.
  6. Once in the order review page, check one last time that all order information is correct. If it is not the case, click on the word "Change" at the end of the line of the erroneous information, correct it and validate each step until you return to this page. If you agree with all the information on the "Review order" page, click on the "Pay now" button to proceed with the payment of your order. This payment will be executed via a secure server and will firmly formalize the sales contract with Awakning Jewelry. Please note that by clicking on the "Pay Now" button, you declare that you are committed to paying for this order.
  7. Wait until your jewelry arrives, then take full advantage of it to express your deepest values.

ARTICLE 7 : PAYMENT

7.1 MEANS OF PAYMENT

The Customer can pay his order online with: Visa, MasterCard, American Express or Apple Pay by our Stripe partner or by using the Paypal service.

The Customer guarantees to the Awakning Jewelry enterprise that he/she has the necessary authorization to use the chosen payment method.

7.2 DEBIT PAYMENT

The debit for purchases on the customer's account is done at the time of the processing of the order.

7.3 SECURE PAYMENT

Awakning Jewelry uses all means necessary to ensure the safety and confidentiality of data transmitted online. To this end, the site uses a protected mode of payment SSL (Secure Socket Layer) which allows the encoding of the customer banking co-ordinates during their transmission on the Internet. It is possible to see that the transmission is encrypted by software from the padlock symbol which appears in the web browser.

The transaction is carried out via the services of Stripe or Paypal which alone receives the encrypted banking information provided on the site at the time of the payment.

Payment information including credit card numbers or paypal ID are both protected by encryption. This information is also salts and hashes using BCRYPT. Storage data is secure and complies with PCI-DSS, ISO 27001 and TIER III certifications.

7.4 AWAKNING'S BANK ACCOUNT

The total amount will be centralized up on the Awakning bank account opened with BOURSORAMA online bank, owned by the french bank, "Société Générale".

ARTICLE 8 : DELIVERY

8.1 DELIVERY SERVICES

Products are delivered to the address indicated by the Customer on the purchase order. The Customer must check the exhaustiveness and the conformity of the information which he/she provides to Awakning Jewelry. The latter cannot be held responsible for possible errors of data entry and the consequences in terms of delay or delivery error. In this context, all expenses engaged for the reforwarding of an order will be entirely the responsibility of the Customer.

8.2 DELIVERY ZONES

The geographical areas of delivery of the articles of Awakning Jewelry are the following:

  • United States & Territories
  • France
  • Canada
  • United Kingdom
  • Australia
  • South Africa
  • Rest of the world (after validation by the company)

The countries open to delivery are displayed on each product page in the "Delivery" tab.

The Customer must contact the Awakning Jewelry customer service to obtain accurate information about the delivery in a specific country/territory in the world other than those mentioned above, before trying to order.

Please note that although we ship internationally, we may not be able to ship to certain countries for logistical reasons.

8.3 DELIVERY COST

All of our orders include basic shipping costs, the cost varies depending on the country. The exact delivery cost is mentioned on each product page under the tab "Delivery" and then throughout the "Check Out" sales tunnel. Awakning limits shipping costs to a maximum of $4 in order to make the products affordable for all budgets. The eventual overage of these fees will be assumed by the company.

However, if Awakning only has carriers that offer prohibitive prices, the company reserves the right to refuse any order.

Under certain conditions, delivery charges may be subject to commercial offers. To once again facilitate access to our products the company decided to offer worldwide free shipping fees on any order from $40. The customer will automatically benefit from the offer and will not have to do anything to take advantage of it.

In specific cases such as ordering the wrong size several times, ordering the wrong model, etc., the customer will be responsible for the costs associated with the reshipment. More information in the article 9.10 Extension to exchange.

8.4 DELIVERY TIMES

The estimated delivery time for a product is displayed on its product page, in the shopping cart, and on the order thank you page. It will also be clearly mentioned in the order confirmation and shipping emails, the latter could even refine the times.

The estimated delivery times mentioned on the site are those which are usually experienced.

Awakning Jewelry, according to french law, guarantees maximum delivery within 30 days for the countries mentioned in the 8.2 Delivery Zones article since the order's day, with the exception of South Africa.

If the parcel has not been delivered on time, the customer can find more information at the article 8.9 delivery Period Exceeded

For countries other than those mentioned in the article on delivery areas (8.2), the delivery can be extended and specific to each country. For this reason, the Customer must contact Awakning Jewelry to ensure that Awakning is able to deliver its products easily before ordering.

Note: Depending on the country, public holidays and possible national vacations may extend the estimated delivery period. These events are therefore not included in the estimated delivery period communicated throughout the purchasing process by Awakning Jewelry and must be taken into account by our customers through the present Terms and conditions of Sale.

8.5 DISPATCHING TIMES & HANDLING TIMES

Each order will undergo a processing time, will be fully checked, tailoring, packaging and delivery to the carrier with a delay from 24 to 72 hours. The processing time is automatically included in the estimated delivery time communicated on our website and through our emails sent before the dispatch email.

In the case of an order which may comprise one or more products, Awakning Jewelry may dispatch the order in multiple packets/parcels at its own expense.

The products are packaged so as to respect the standards of transport in force, and to ensure an optimal protection of the products during their delivery.

Then an email is automatically sent to the Customer at the time of dispatch of the products. By this email, the Customer can take into account a more precise delivery period

8.6 DELIVERY TRACKING

For all our orders, each parcel receives a tracking number just before it leaves for transit. The tracking number will be taken into account in the dispatch email sent to the customer, allowing this latter to track its parcel.

Customers can track their package(s) from :

  • The confirmation dispatch email where the customer may click on "Track your shipment" then clicking on the "Track" button corresponding to its order or by clicking on the "View your order" button, then on the tracking number displayed.
  • The Customer account interface directly by clicking here (https://www.awakningjewelry.com/account) then the "Track" button corresponding to its order.
  • The tracking page whose link is displayed in the footer of the website or by clicking here (https://www.awakningjewelry.com/apps/trackorder) then by informing its tracking code or its order number with email address and clicking on the "Track My Order" button.

8.7 TAXES & CUSTOMS FEES

In rare cases, these orders are subject to possible taxes and customs fees according to the country of delivery. For all our sales, the transfer of costs and risks will take place according to the DAP Incoterm in the latest version of the ICC in effect at the time the payment of the order is made. DAP is the most widely used method of managing the international delivery relationship from merchant to customer. To summarize the DAP method, Awakning is responsible until the order is delivered to the address mentioned by the client at the time of the order, while the client is responsible for taking possession of the goods, and may have to bear any customs fees.

We recommend that our customers check with the customs authorities in their country to find out if they may have to pay customs fees and the approximate amount before validating their order.

Note : US customers are free of import tax & duties below $ 800, since President Barack Obama modified the TFTEA in 2015 Feb 24.

8.8 DAMAGED PARCELS / DAMAGED ITEMS

Awakning Jewelry reminds that it is the responsibility of the Customer to inspect his parcels and item(s) upon reception. In the case of any damage to the item(s), the Customer is ask to notifying expressly Awakning Jewelry by email at contact@awakningjewelry.com and to send us picture(s)/video(s) of the damaged product, of the box and the package to allow us to investigate the causes of the deterioration. Thus, the buyer may request a replacement at our cost of the damaged product within 30 days after delivery of the order (60 days during the Christmas period).

8.9 DELIVERY PERIOD EXCEEDED

If it happens that initial delivery times cannot be met, the Customer can contact Awakning Jewelry to ask for a search of the parcel. Awakning Jewelry remains responsible to deliver the order during an additional period similar to the initial delivery times. This additionnal period allows to Awakning Jewelry to retrieve the parcel and have it delivered to the customer or to send another order at the company's expense. If the parcel still not delivered to the end of the second period, the Customer can cancel the order and ask for a total refund.

Note : If any package is received by the Customer in duplicate or after the refund of the order, it is ask to our customer to send it back, to make sure to get the proof of the return shipping cost they paid and then email it to us, so we can refund the customer of the shipping cost with all our respect.

ARTICLE 9 : MONEY BACK GUARANTEE / RIGHT OF WITHDRAWAL (Return & refund Policy)

9.1 LEGAL WITHDRAWAL LAW

In accordance with the advantageous provisions in force in France and in Europe, that make the right of withdrawal/Money Back Guarantee mandatory, we are committed to respecting this law and to making it available to all our international customers. Thus, the latter can return one, several or all the products of their order to ask for a refund. This right may be exercised without having to give any reason - Article L.221-18 French Consumer Code

The law gives the customers a maximum of 14 days from the date of receipt of the items to notify the company that he or she is exercising the right of withdrawal - Article L.221-21 French Consumer Code. But our service prefers to offer customers a more beneficent delay, increasing the period from 14 calendar days to 30 calendar days (60 days during the Christmas period).

Note : this right of withdrawal can also be exercised upon ordering and during the delivery period.

If the Customer fails to meet the deadline, Awakning Jewelry will not be able to refund the Customer.

9.2 LEGAL WITHDRAWAL CONDITIONS

To be eligible for the Money Back Guarantee, products must be returned to us, with their boxes, all in perfect condition. It must be as new and be able to be resold. Because, any mark of use will lead to a reduction in the value of the item, which can then be resold as second hand product - Article L.221-23 French Consumer CodeIn this case, the refund can be canceled or partially executed.

Thus, the product(s) must be returned to us for an estimation of its condition to determine if the refund will be full or partial.

To avoid the customer being held responsible for any damage during transport to our return address, we advise our customers to take pictures/videos of the items, their boxes and the package before shipping it.

Every return made by the customer must be previously agreed by the Customer Service.

9.3 RETURN DELAY

Once Awakning Jewelry has accepted the return, it will inform the customer. This latter must send us the product(s) within 14 days Article L.221-23 French Consumer Code.

9.4 RETURN SHIPPING COST

The return shipping costs remain the responsibility of the Customer, who is also free to choose the shipping method Article L.221-23 French Consumer Code.

    9.6 RETURN PROCEDURE

    Reminder: Every return made by the customer must be previously agreed by the Customer Service.

    For each return, the Customer must provide the order number with the item(s) concerned. The better option is to provide the Order receipt with the item(s). If the customer is unable to provide this receipt, Awakning Jewelry accepts any other document or personal note that mentions clearly the order number. The Customer is informed that the use of the mentioned document is essential to the return procedure by Awakning Jewelry.

    It is requested from the Customer to respect these same package conditioning standards in the case of a product being returned because of after-sales service or for reasons of suitability.

    In all cases, the return is made at the risk of the Customer. It will be up to the customer to keep any proof of return.

    9.8 REFUND OF THE ORDER

    The refund of the product(s) concerned will be made by the same means of payment as that used by the Customer for the initial transaction, unless otherwise specified by the Customer who would request a store credit, valid for one (1) year from its issue Article L.221-24 French Consumer Code.

    A refund is made as soon as possible and, at the latest, within 14 days following the reception of all the order's items. If the fourteen (14) days period expires on a Saturday, Sunday, holiday or non-working day, it is extended until the next business day.

    9.9 REFUND LATE PENALTIES

    If Awakning Jewelry does not reimburse the Customer within 14 days, the company will have to pay penalties to its customer Article L.242-4 French Consumer Code. The initial amount paid by the Customer will automatically be increased, following this conditions:

    • by 5% if the delay is between 10 and 20 days
    • 10% if the delay is between 20 and 30 days
    • 20% if the delay is between 30 and 60 days
    • 50% between 60 and 90 days and five additional points per new month of delay up to the price of the product, then the legal interest rate.

    9.10 EXTENSION TO EXCHANGE

    We have decided to extend the money back guarantee to offer our customers the possibility to exchange their item once if it does not suit them or if they ordered the wrong product and want another model. This guarantee extension is not mandatory, it is an initiative of ours.

    This guarantee is available for 30 days year round and 60 days during the Christmas season.

    The item to return and its box must be in perfect condition for the customer to benefit from this right to make a mistake. Likewise, return shipping costs are at the customer's expense. The shipping costs of the new shipment will be paid by Awakning Jewelry within the limit of one exchange. If the customer makes a new mistake and asks again for an exchange, any new shipment will be at his expense. In all transparency, these costs are available to the customer from the table of shipping costs presented in the answer to the question "How much does shipping cost?" of our FAQ.

    ARTICLE 10 : LEGAL GUARANTEE OF CONFORMITY

    10.1 DESCRIPTION OF THE GUARANTEE

    In accordance with the provisions in force in France and in Europe, any item purchase must be in conformity with the expected use and the seller's description. The customer has a period of 2 years from the delivery of the product to contact Awakning, to ask for a replacement and don't have to prove that the defect of the Products existed at the time it was delivered. This guarantee is called Legal Guarantee of Conformity and we undertake to make all our international customers benefit from this law - article L.217-4 to L.217-12 of the French consumer Code.

    Note : French and European laws provide that the customer has the choice between repairing the defective item or replacing it. As Awakning does not offer a repair service, only replacement is possible.

    10.2 CASES OF APPLICATION

    The seller must deliver a good in conformity with the contract. He is responsible for the defects of conformity existing at the time of the delivery of the good.

    To be recognized as non-conforming, the customer's product must meet one of the following points:

    • the good is not in conformity with the usual use of a good of the same type
    • the good does not correspond to the description given by the seller
    • the good does not have the qualities detailed in an advertisement or in its labeling
    • the good does not correspond to the special use the user are looking for contrary to what the seller said
    • the good has a manufacturing defect, an imperfection, a bad assembly

    More simply, if the product does not correspond to what was presented by Awakning, to what was described in the order, to the expected use, to the expected quality, it can be eventually considered as non-conforming and be eligible for the legal guarantee of conformity.

    10.3 CASES OF EXCLUSION

    To be eligible for the Legal Guarantee of Conformity, the product must have been used in accordance with their intended purpose, not excessively or inappropriately. The buyer can not invoke this guarantee if he/she is at the origin of the defect of the Item resulting from manipulations other than those necessary to establish the nature, characteristics and, as the case may be, the proper functioning of the Item - article L.221-23 French Consumer Code.

    In addition, the Customer cannot invoke the legal guarantee of conformity in the following three situations as set out in article L. 217-8 French consumer Code:

    • when he knew about the defect when he entered into the contract;
    • when he could not have been unaware of the defect when he entered into the contract;
    • when the defect is the result of materials that he himself provided.

    10.4 LIMITATIONS

    Awakning jewelry has made the choice not to have a repair service for the moment. This decision was made in agreement with the article L. 217-9 of the French consumer Code, which allows us to avoid disproportionate costs which in our case would have been reflected in the price of our jewelry. Thus, any request of repairing will considere as a request of replacement.

    If Awakning Jewelry is unable to replace the item, the Customer will be refunded the price of the item and its eventual shipping costs and custom fees. More information on refund in the article 10.10 Potential Refund of the Order.

    When Awakning Jewelry is in possession of an element attesting that the defect could no have existed at the time of delivery as regards the nature of the Product or the defect invoked, the company shall remind to customer of its existence in order to demonstrate its non-eligibility for the legal guarantee of conformity.

    10.5 LEGAL GUARANTEE OF CONFORMITY PROCEDURE

    To assert his right for this guarantee, the customer must send his request to the Customer service. The customer must provide in its request the following elements :

    • Its order number
    • Mentions that he/she wants to make use of the legal guarantee of conformity
    • The name of the product concerned

    Awakning Jewelry will process the request as soon as possible. Please note that to ensure that the product is eligible for the legal guarantee of conformity, the company may ask you to provide photos/videos of the item.

    If the customer's request is made less than 30 days after delivery (60 days during the Christmas period), the company will send a new product without waiting for the return of the non-compliant product.

    If the time limit has been exceeded, a new product can only be sent after the concerned item has been received by our company to ensure that it is non-compliant.

    Any shipment of a new product under this guarantee will be at the expense of the company.

    10.6 RETURN DELAY

    We recommend that our customers return the affected item within 14 days of our return approval. The sooner the product is received, the sooner Awakning will ship a new product.

    10.7 RETURN SHIPPING COST

    The return shipping costs remain the responsibility of Awakning Jewelry. The client will have to advance them, transmit a proof of the expenses he/she will have exactly paid to Awakning in order to be refunded. However, the amount will be limited to a ceiling corresponding to the standard cost of a similar parcel tracked by post.

    10.8 RETURN PROCEDURE

    Reminder: Every return made by the customer must be previously agreed by the Customer Service.

    For each return, the Customer must simply provide the order number with the item(s) concerned. The better option is to provide the Order receipt with the item(s). If the customer is unable to provide this receipt, Awakning Jewelry accepts any other document or personal note that mentions clearly the order number. The Customer is informed that the use of the mentioned document is essential to the return procedure by Awakning Jewelry.

    10.10 POTENTIAL REFUND OF THE ORDER

    If a product is out of stock or is no longer offered for sale, the replacement will be impossible. In that case, the product and any shipping costs and customs fees will be refunded to the customer. However, the customer will have to provide proof of the customs fees he has assumed if he wants to be reimbursed for these expenses.

    The refund will be made by the same means of payment as that used by the Customer for the initial transaction, unless otherwise specified by the Customer who would request a store credit, valid for one (1) year from its issue.

    The refund will be made as soon as possible and no later than 14 days. If the fourteen (14) days period expires on a Saturday, Sunday, holiday or non-working day, it is extended until the next business day.

    10.11 REFUND LATE PENALTIES

    If Awakning Jewelry does not reimburse the Customer within 14 days, the company will have to pay penalties to its customer Article L.242-4 French Consumer Code. The initial amount paid by the Customer will automatically be increased, following this conditions:

    • by 5% if the delay is between 10 and 20 days
    • 10% if the delay is between 20 and 30 days
    • 20% if the delay is between 30 and 60 days
    • 50% between 60 and 90 days and five additional points per new month of delay up to the price of the product, then the legal interest rate.

    10.12 CUMULATION OF GUARANTEES AND RIGHTS

    The legal guarantee of conformity applies independently of any commercial warranty or guarantee related to hidden defects potentially agreed.

    In addition, these provisions do not deny the Customer the benefit of his right of withdrawal as set out in Article 9 : Money Back Guarantee / Right of Withdrawal.

    ARTICLE 11 : GUARANTEE RELATED TO HIDDEN DEFECTS

    11.1 DESCRIPTION OF THE GUARANTEE

    In accordance with the provisions in force in France and in Europe, any item purchased must be free of non-visible defects. The customer has a period of 5 years from the day of the order, and 2 years after the discovery of the defect to contact Awakning, to ask for a total or partial refund of the product accompanied by proof that the defect existed at the time of purchase. This guarantee is called Guarantee related to Hidden Defects and we undertake to make all our international customers benefit from this law - articles 1641 to 1648 of the French Civil Code.

    11.2 CASES OF APPLICATION

    Product displays a hidden defect that makes it unsuitable for use or that so diminishes such use that the Consumer would not have purchased it, or would only have paid a lower price, if he or she had known of it.

    11.3 CUSTOMER RIGHTS

    If the Product displays a hidden defect, the Customer may choose either to return the Product to Awakning Jewelry and obtain the reimbursement of the price and the fees occasioned by the sale (such as eventual delivery charges and custom fees), or to retain it and obtain the reduction of a part of the price - article 1644 French Civil Code

    An action under the guarantee against hidden defects must be brought within five (5) years of the delivery of the product, and within the limit of two (2) years of the discovery of the defect - article 110-4 French Commercial Codearticle 2224 French Civil Codearticle 1648 French Civil Code.

    11.4 CONDITION OF APPLICATION

    It is up to the Customer to prove the existence of the hidden defect. To do this, the Customer can produce the various repair certificates or repair estimates.

    The Customer can also ask for an amicable expertise.

    Please note that Awakning Jewelry does not issue refunds for any repairs paid by the customer.

    11.5 GUARANTEE RELATED TO HIDDEN DEFECTS PROCEDURE

    To assert his right for this guarantee, the customer must send his request to the Customer service. The customer must provide in its request the following elements :

    • Its order number
    • Mentions that he/she wants to make use of the guarantee related to hidden defects
    • The name of the product concerned
    • Picture(s)/video(s) of the defective/concerned product
    • Proof that the Product was affected by the said hidden defect on the day of the sale
    • His choice of a partial or total refund

    Awakning Jewelry will process the request as soon as possible. The company will make a first inspection of the product thanks to the picture(s)/video(s) to ensure that the defect could be covered by the guarantee related to hidden defects.

    If the customer asks for a partial refund, the refund cost will be defined by Awakning through the pictures/videos provided by the customer and the company will refund the customer as soon as possible, within 14 days.

    If the customer has requested a full refund, the customer will be asked to return the product for a second inspection necessary to ensure the defect. If the defect is proven, Awakning will proceed as soon as possible to the total refund to the customer within the limit of 14 days.

    11.6 RETURN DELAY

    11.10 REFUND OF THE ORDER

    If a total refund has been requested, the product and any shipping costs and customs fees will be refunded to the customer. However, the customer will have to provide proof of the customs fees he has assumed if he wants to be reimbursed for these expenses.

    If the refund requested is partial, only the product will be compensated.

    The refund will be made by the same means of payment as that used by the Customer for the initial transaction, unless otherwise specified by the Customer who would request a store credit, valid for one (1) year from its issue - Article L.221-24 French Consumer Code.

    Reimbursement shall be made as soon as possible and, at the latest, within 14 days of receipt of the item concerned for a full reimbursement request or within the same period after Awakning has granted the client's request for a partial reimbursement. If the fourteen (14) days period expires on a Saturday, Sunday, holiday or non-working day, it is extended until the next business day.

    11.11 REFUND LATE PENALTIES

    If Awakning Jewelry does not reimburse the Customer within 14 days, the company will have to pay penalties to its customer Article L.242-4 French Consumer Code. The initial amount paid by the Customer will automatically be increased, following this conditions:

    • by 5% if the delay is between 10 and 20 days

    ARTICLE 12 : REMINDER OF REGULATIONS

    ARTICLE 13 : LIABILITY & FORCE MAJEURE

    Awakning Jewelry cannot be held liable in the case of failure to perform or incorrect performance of the agreement due to the Customer or due to an unforeseeable and insurmountable factor in connection with a third party to the agreement or in the event of force majeure.

    We shall not be liable for the non-performance or the delay in the performance of any which of our obligations when the said non-performance is due to a situation of force majeure, to wit – and without the following listing being in any way exhaustive – in the event of fire, hail, natural disaster, strike, maritime or inland waterway transport incidents or accidents, or the carriage of mail of any other kind of transport.

    In the event of force majeure, our contractual obligations will be maintained during the entire duration of the force majeure but our fulfilment deadlines shall be extended by a length of time equivalent to that of the duration of the force majeure, as applicable. Awakning Jewelry reserves the right to make any decision at any moment depending on the evolution of the situation, including the cancellation of the order, execute another shipment, contact a third party to unblock the situation, etc.

    ARTICLE 14 : ENTIRETY OF CONDITIONS

    A change of legislation, regulation or a decision of the court rendering invalid one or more clauses of these Terms and Conditions of Sale will not affect the general validity of these Conditions. Such a change cannot in any way make it possible for the Customer not to observe these Terms and Conditions of Sale.

    According to the laws in force in France, if a condition is not explicitly mentioned, it will be regarded as conforming to usage in the sector of mail order sales by companies based in France.

    ARTICLE 15 : INTELLECTUAL PROPERTY

    The Website, as well as all rights relating to it, are the property of Awakning Jewelry. All elements of the Website are protected by intellectual property rights, trademarks or patents. They are the exclusive property of Awakning Jewelry. Therefore, they cannot be reproduced, employed or used in any way whatsoever.

    ARTICLE 16 : GOVERNING LAW AND JURISDICTION

    The Contract and any dispute or claim arising out of or in connection with it or its subject matter or formation (including non-contractual disputes or claims) will be governed by and construed in accordance with the laws of France, and the Customer hereby irrevocably agrees that the French courts shall have exclusive jurisdiction in relation to any claim brought by the Customer against the company, but Awakning Jewelry shall be entitled to bring a claim against the Customer in any court of competent jurisdiction.

    ARTICLE 17 : MEDIATION, CLAIM & DISPUTE

    In the event of a claim or a dispute, it is agreed to seek an amicable solution before any legal action by contacting the Customer Service or by email to contact@awakningjewelry.com.

    It is specified that Awakning Jewelry adheres to the Code of Ethics of the FEVAD (“Fédération du E-Commerce et de la Vente A Distance”/"Federation of E-Commerce and Distance Selling") and to the e-Commerce Mediation system of this federation. The Customer can therefore contact the FEVAD mediation service by clicking on this link http://www.mediateurfevad.fr/index.php/contact/ (French website).

    In addition, in accordance with Article L.616-2 of the French Consumer Code, Awakning Jewelry informs the Customer of the existence of the platform published online by the European Commission which aims to collect claims from any purchase of European consumers online and then forward the cases to the competent national ombudsmen.     The customer may also refer the International Chamber of Commerce to ask for an arbitration by contacting them directly at the Headquarters in Paris (France) :

    All disputes arising out of or in connection with the present contract shall be finally settled under the Rules of Arbitration of the International Chamber of Commerce by one or more arbitrators appointed in accordance with the said Rules.

    If the two parties decide not to call on arbitration, the dispute will first be brought before the Court of Commerce of Versailles (France) or the Court of Commerce of Paris (France), and the applicable Law will be French law. Nevertheless, Awakning Jewelry reserves the right to bring the dispute before the Courts of the place of the Buyer’s registered address, in which case the applicable Law will be the Law of the country of the Debtor, or a neutral Law, i.e Swiss law.
